Boudoir photography, by definition, may include nude or suggestive poses and themes. The acceptance of this terms and conditions states your understanding that it is your choice to participate in these photos and you will not hold Faby and Carlo Photography responsible for any negative actions or feelings that may arise due to the images of this photo session. You understand that you will decide whether or not these images are made public, and will make Faby and Carlo Photography aware of your preference. Based on the print/product agreement you are agreeable to the terms, conditions and timeline of the session, and the delivery of images and products.
You state that you are 18 years or older. License usage rights are transferred upon full payment of the invoice. Failure to make payments voids any licence granted and constitutes copyright infringement. All rights not specifically granted in writing, including copyright, remain the exclusive property of Carlo and Fabiana Nicora.
Our services and products are for personal use only. Any professional or commercial use of our copyrighted images is prohibited. Different rates and prices apply to commercial and professional use of the photographs created by Faby and Carlo Ltd and can be discussed upon request.

Additional products or services can be purchased after the session. Prices may be subject to change at any time without notice. This contract solidifies the package contents and price at the time of booking. This contract is specifically for services and products acquired on the date of the purchase. Any addendum made to this contract must be agreed upon, in writing, by all parties involved.

The retainer fees are required to secure the date of your Boudoir Photographic session. In the event of a cancelled session, this retainer fee is non-refundable. Payment of the retainer fees is client’s acceptance of terms and conditions as outlined in these terms and conditions.

If you purchase a pre-packaged deal or an offer, the remainder of the payment amount is due by the day before the scheduled session. Faby and Carlo Photography reserves the right to refuse services/products if the payment arrangements have not been met unless different arrangements have previously been made in writing.

You agree that all products must be paid for in full before work will be started on them. Once payment is made, no refunds will be granted.

In the event that you specify a certain location must be used for the shoot, you are responsible for all location fees involved. These may include variables such as location access fees, parking, and so on. You are also responsible for arranging the location access and any permits or pass related to doing so. No additional fees will be charged in the event additional people (up to a maximum amount of 3 people per session) are taking part in this boudoir or portrait session.

Due to the nature of these photography sessions, completion and product delivery time may vary.

All our products are normally delivered in person. If the shipment of the products is required, you will be charged for the cost of the shipment to your chosen address.

We always take great care in using professional delivery services to deliver the products to the chosen address; however, Faby and Carlo cannot deem responsible for the loss of the data or products once the parcel has been given to the delivery partners.

You agree that the proofs received have been edited at the discretion of Faby and Carlo. Any extra editing requests are subject to a service charge and at the discretion of Faby and Carlo the with right of refusal. It is at the discretion of Faby and Carlo to not include a photo if it is not up to self-defined technical standards.

Faby and Carlo Photography is not held responsible for the behaviour of third parties involved in the shoot, with the exception of Faby and Carlo Photography employees. If the desired outcome of your session is jeopardised by the behaviours of third parties involved, with the exception of Faby and Carlo Photography employees, Faby and Carlo Photography cannot be held responsible.

In the unlikely event that the photographer is injured or becomes too ill to photograph the session, Faby and Carlo Photography will make every effort to secure a replacement photographer unless otherwise specified by you. Should the situation occur and a suitable replacement is not found or accepted, another shoot will be rescheduled for the next available time slot. In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Faby and Carlo Photography control, Faby and Carlo Photography liability is limited to the reshoot of the portrait session at the expenses of Faby and Carlo Photography.
Under no circumstances, you are permitted to touch or use the photographic equipment and make-up artist tools and products. We will not accept any responsibility for claims of damages, injuries or losses occurred under these circumstances.
It is your responsibility to make Faby and Carlo and our collaborators aware of any allergies and sensitivities you may have.

You agree that if you give Faby and Carlo permission to share photos online, Faby and Carlo select the images.

You understand that Faby and Carlo own all images taken during the Boudoir Photography Session. You understand that the photos will not be posted unless you give Faby and Carlo explicit permission.

If you give Faby and Carlo explicit permission in writing, Faby and Carlo will be granted full permission to display these images in locations including, but not limited to; online websites, blogs, in the studio, online or printed promotional material, social media sites such as Facebook, Instagram, Pinterest and/or in any printed media. You cannot choose afterwards to have these photos removed and they will not be removed if asked. If Faby and Carlo make an exception and agree to remove the photos, you agree to pay an administrative/damage fee of £100 per photograph.

You agree that you do not have any claim to copyright, patent, or other ownership of the photographs. You understand that you have purchased the rights to share the images online or print the digital files only and that the images may not be altered/edited or cropped in any way.

You agree that if you wish to submit the photos to an online or printed publication, you must obtain written consent from Faby and Carlo prior to doing so.

You agree that no monetary gain may be acquired at any time from the sale of the images. This action is illegal and will result in legal action at your expense.

You agree that all images must be sourced at all times. You understand that you may post images on sites including, but not limited to; Facebook, Twitter, Instagram, social forums, Pinterest and/or through use in emails and agree that you will credit Faby and Carlo every time he/she does so. Images posted to any online media platforms that are not sourced will be reported to the site and removed. Repeated failure to properly source images will result in legal action

You agree that all information and documents given to you are the exclusive property of Faby and Carlo and are confidential information. They may not be sold, shared or copied.
You acknowledge that Faby and Carlo will not be held responsible for the final destination of the images if permission is given to share them for promotional purposes.
You agree that by accepting this terms and conditions, you release Faby and Carlo of any and all liability. You assume all risk and has no legal recourse against Faby and Carlo. This includes, but is not limited to; personal injury, loss of income, damage to personal items, emotional distress, illness, loss of property, paralysis or death, as well as negligence of Faby and Carlo.
You agree that while Faby and Carlo will take all care, circumstances beyond Faby and Carlo’s control could result in the loss, damage or failure of products and/or equipment. If image files are damaged, lost or corrupted, as deemed by Faby and Carlo, liability shall not exceed a re-shoot to take place within, but no later than, 90 days. No monetary reimbursement will be provided.
You agree that you must back up the digital negatives once received. Faby and Carlo are not responsible for the storage of the images after this time. You agree that Faby and Carlo are not responsible for updating the files as technology advances.
You agree that Faby and Carlo are not at fault or in any way liable if anyone else present at the session is hurt/injured at any time. This includes, but is not limited to; children, caregivers, additional family members or friends or persons of any nature.
You agree that you are of legal age to participate in a Boudoir Photography Session. You understand it includes nudity and that you will be photographed wearing little and/or no clothing. You understand what a Boudoir Photography Session is, and is signing this Contract in full competency, without being coerced, influenced and of his/her own free will.
You agree that the level of nudity you shows during the Boudoir Photography Session is at your own discretion. You agree that you will not do anything you are uncomfortable with and will speak up at the time if uncomfortable with a certain level of nudity or a pose.
Faby and Carlo is a professional and shoots in a professional manner. You agree that you will in no way hold Faby and Carlo responsible or liable for sexual inappropriateness.

Once the payment of the retainer fees is submitted, there are no refunds for cancellation. However, you may reschedule. Rescheduling must be arranged in writing up to 72 hours prior to the session date and it is only permitted once. If your request to reschedule the session is made with less than 72 hours’ notice before your session date, an additional retainer fee will be required to book the new session.
If you are late for your scheduled session, the time that you are late will be deducted from your session.

Faby and Carlo Ltd only work with professional make-up and hair artists.
Hair and make-up are done as per your request and under concerted suggestions of the make-up artist and Faby and Carlo. If for any reason, you are unhappy with hair and make-up, you must express your opinion prior to being photographed, so that make-up and hair stylists can perform corrections. Any claim of dissatisfaction with hair and make-up after the photo session will be disregarded.
If you have any allergies or sensitivities to makeup or product, it is your responsibility to make Faby and Carlo and the make-up artist aware, and you are welcome to bring your own products for the make-up artist to use.
Under no circumstances, you are permitted to touch or use the make-up artist tools and products. We will not accept any responsibility for claims of damages, injuries or losses occurred under these circumstances.

Faby and Carlo Photography main goal is customer’s satisfaction, but all art is subjective. In the unlikely event you are not satisfied with the quality of the resulting photographs, Faby and Carlo Photography shall refund you the purchased package less the retainer fees and travel and accommodation costs. Faby and Carlo Photography will process the refund within thirty (30) days from your refund request.
